Terms & Conditions

Unless the context otherwise requires, the following words and expressions are used in these Booking Conditions with the following meanings:

“Client” – a person who is interested in booking a tour and/ or has made a prepayment and/ or has paid for the booking and/ or is a participant in a Loveyachttours event.

“Trip, Adventure, Tour, Vacation, Event, Yachtfest” means a place on a tour booked with Loveyachttours.

“Ambassador” – an agent representing Loveyachttours who has the authority to give a personal promo code to a person interested in a Loveyachttours yacht charter.

LTD Garant EU, operating under the Loveyachttours brand, organizes events for private clients or legal entities. Such events are organized in the form of trips, yacht regattas, adventures and races. Clients can book individual room/cabin spaces, the entire room/cabin or the entire yacht/apartment.

A contract between you and Loveyachttours shall arise when Loveyachttours receives your booking deposit from you as described later in this document.

By making a booking, the first person named in the booking agrees on behalf of all persons named in the booking that:

– he/she has read these Booking Conditions, is authorized and agrees to be bound by them;

– he/she consents to our use of personal data in accordance with our Privacy Policy and is authorized on behalf of all persons named in the booking to disclose their personal data to us, including, where applicable, special category data (such as health or disability information and dietary requirements);

– he/she is over 18 years of age and, in the case of a booking for age-restricted services, declares that he/she and all members of the group are of legal age to purchase those services;

– he/she accepts financial responsibility for payment of the booking on behalf of all persons named in the booking.

A booking is made when you make the first installment of your payment (deposit or full payment if you book within 35 days prior to departure) and we provide you with a booking confirmation. We reserve the right to refund your deposit and refuse to issue a booking confirmation at our discretion.

The group responsible must provide us with a list of members at least 30 days prior to the start of the tour. Please note that we forward all messages exclusively to the person in charge of the group. Further forwarding of messages to the rest of the group members is his/her area of responsibility.

Unless otherwise agreed separately for a particular tour, we check-in to the yacht/apartment from 4pm on the first day of the tour and check-out time is by 10:00am on the last day of the tour.

Loveyachttours selects the best quality, safest and most comfortable apartments, hotels, yachts and catamarans on the market. The illustrations are for information purposes only. There may be differences between the apartments, hotels, yachts and catamarans shown as examples and those that will actually be. Full correspondence to the images sent as an example is not guaranteed, as the images are provided for information purposes only.

We pass on to you all information about excursions and other activities that may influence your booking decision at the time of booking. Every effort is made to keep to the schedule of activities, however we cannot guarantee absolute accuracy in terms of timing in relation to each activity. Please inform us by email of events that are not part of your contract with us but are important to you so that we can keep you informed, bearing in mind that these types of events are outside our control and area of responsibility.

The availability of visas, passports and other documents required for travel is the responsibility of the Client. With regard to flights and other travel arrangements on your part, we shall not be liable for any incidents that may affect your booking made with us; nor shall we reimburse any funds due to missed/cancelled flights or other similar circumstances. Any arrangements and compensation in the event of delay or cancellation are the responsibility of the relevant airline or other service provider and/or your travel insurance agent.

It is an absolute and mandatory requirement that you and every member of your group have a travel insurance policy. It is the Client’s responsibility to take out travel insurance. Please note, your insurance should fully cover all your personal requirements including existing medical conditions, trip cancellation costs, medical expenses and repatriation in the event of accident or illness, personal belongings and money, and cover active leisure activities including yachting.

By making a booking with us, you confirm that you and all members of your group have taken out or will take out a proper travel insurance policy, valid for the duration of your trip. We reserve the right to request a copy of your insurance policy and you must take a copy of the insurance policy with you on your tour. If you choose to travel without adequate insurance cover, we will not be liable for any loss arising in any way.

It is also your responsibility to check (including through consultation with your doctor) your ability and fitness to travel with us on a tour with planned activities. If the medical condition of anyone in your group may affect your travel, you must inform us before the tour starts. You must carry any medication you may need at all times. You must also inform us in writing of any special requests you have at the time of booking and we will fulfill them to the best of our ability.

Disabled people and medical specialties

Loveyachttours is not a specialized travel company for people with disabilities, but we will do our best to accommodate any special requirements you may have. If you or any member of your group has any medical conditions or disabilities that may affect your booking, please provide us with full details prior to booking so that we can advise you on your chosen activities.

In the event that the Client participates in the tour under the influence of alcohol or drugs, loveyachttours will not be liable for any loss or consequences arising in any way whatsoever.

At the time of settling into the apartment/yacht you must sign an Agreement, which will contain all the provisions of these Booking Conditions as well as the safety provisions on board. It is the responsibility of the senior member of the group to have all members of the group sign the Agreement and submit it to Loveyachttours.

We accept Visa and MasterCard payments, as well as bank transfers, cash and cryptocurrencies.

Loveyachttours does not have access to your bank card information, bank account numbers, or other personal financial information sent to processing services.

If you have a promo code for a Loveyachttours event received from Ambassador, please provide it prior to payment.

– The first payment (deposit) of 50% of the total cost of the trip is due no later than 48 hours from the date of booking;

– The second payment of 50% of the total cost of the trip is due no later than 35 days before the start of the tour;

– In the event that 35 or less calendar days remain at the time of booking confirmation before the start of the trip, 100% of the total cost of the trip is due no later than 48 hours from the time of booking;

– Failure to pay the second payment of 50% of the total cost of the trip 35 calendar days or less before the start of the trip will be considered by Loveyachttours as a cancellation of your booking. Cancellation fees will apply – see ‘Cancellation Fees’ below.

Loveyachttours reserves the right to make changes and correct the trip price data contained in our materials at any time prior to confirming your booking.

To make any changes to a booking, the Client shall notify us in writing as soon as practicable. We do not charge for name changes, however we will re-bill the Client for any costs that will be incurred by us or our suppliers in initiating changes to a confirmed booking by you if we are able to make such changes to the booking.

Due to the nature of our trips, all of our guides and group in charge are entitled to make changes to the itinerary of the trip for any reason, particularly if it is in the interests of the health and safety of the participants.

AGE RESTRICTIONS

Loveyachttours reserves the right to cancel your booking if you are under 18 or over 55 years of age. In such a case, we will notify you of the cancellation appropriately and issue a full refund.

OTHER REASONS

Although we make every effort to avoid canceling your reservation, from time to time these situations are unavoidable. We will notify you of the cancellation as soon as possible prior to the start of the tour, and you will be able to, at your option:

Accept the new travel arrangements, or
Book an alternative trip similar to the original trip, if available, and we will refund the difference in price if the substitute trip is lower in terms and conditions or price, or
Accept the cancellation and receive a full and prompt refund of all monies paid.

When you make a booking with us, we book the apartments/yachts/autos/entertainment and accept a number of financial obligations to the accommodation and vehicle owners and other service providers for the purpose of arranging your trip.

However, we realize that there may be situations where cancellation of your reservation is unavoidable on your part. If you decide to cancel your booking, you or the person in charge of your group (in the case of a group booking) must notify us immediately by emailing info@loveyacht.tours.

Any cancellation made within the first 48 hours of your booking will not be subject to a cancellation fee. Cancellations made later will incur a charge to cover our financial obligations incurred in connection with the travel arrangements. You can purchase travel insurance to cover cancellation charges.

The cancellation fee is equal to the full amount payable to us at the time of cancellation. In this case, your choice of payment method – in installments or in a single payment at the time of booking – is irrelevant.

CANCELLATION FEE

– Cancellation within the first 48 hours of booking – no cancellation fee will be charged;

– Cancellations from 48 hours after booking and up to 35 calendar days before the start of the trip – a cancellation fee of 50% of the total cost of the tour will be charged;

– Cancellations made 35 calendar days or less before the start of the trip will be charged a cancellation fee of 100% of the total cost of the tour.

If the agreed payment arrangement for your trip differs from the standard payment arrangements above, the cancellation fees may also differ from those set out in this article. Please check with us for the relevant information.

Loveyachttours makes every effort to fulfill all contractual obligations made to you in a timely and complete manner. Except in situations where we breach a contract, any matters relating to your trip are at your own risk. You are responsible for all claims, liabilities, damages, costs and expenses incurred or resulting from breach or default on your part.

Loveyachttours shall not be liable for damage, loss, expense, injury, illness or death if a claim on your part results from:

1.Any act, omission or failure to act of a third party;
2.Any act, omission or failure to act on the part of any member of staff if they have not acted within the scope of their job duties assigned to them by us;
3.Incorrect information provided by you or a member of your booking;
4.Blocking of any of our emails by filters or firewalls;
5.Any act, omission or failure to act by any of our contractors;
6.Any act, omission or failure to act by a third party unrelated to the organization of your travel that is unforeseeable or unavoidable;
7.Any act which may lead to the occurrence of a Force Majeure event (see below).

In any event, the maximum amount of our liability in respect of any successful claim shall not exceed an amount of expenses equal to the amount equivalent to the deductible on your insurance policy which applies to that type of loss per person generally, as you are required to have adequate insurance to cover any loss of this nature.

Excursions or other tours that you may book or pay for while using the services do not form part of your contract with us. In respect of any activity, entertainment, excursion or other tour you book, your contract will be with the operator of the excursion or tour and not with us. We are not responsible for the provision of the excursion or tour or for anything that happens in the course of its provision by the operator.

Supplier Terms and Conditions:

Many of the services that make up your booking are provided by independent suppliers. These suppliers provide such services in accordance with their own terms and conditions, which will form part of your contract with us. Some of these terms and conditions may limit or exclude the supplier’s liability to you, usually in accordance with applicable international conventions. Copies of the relevant parts of these terms and conditions are available on request from us or the relevant supplier.

We accept no liability for any accident, act or omission resulting from excessive or irresponsible consumption of alcohol by you or any member of your company.

Loveyachttours shall not be liable for any breach of obligations under these Booking Conditions, nor shall Loveyachttours pay any compensation for any such breach if it results from force majeure.

For the purposes of these Booking Conditions, the term force majeure means any circumstance that we could not have foreseen, avoided, including fire, flood, storm, high winds, earthquake, hurricane, nuclear disaster, civil unrest, acts of terrorism, acts of war, labor disputes, governmental restrictions, or other calamities of a similar nature beyond our control. In the event of governmental restrictions (whether by a Loveyachttours member state or by the state where the Loveyachttours event is taking place), including due to the spread of coronavirus infection, these events will be treated as force majeure.

Loveyachttours ensures the security of your data and takes customer information as seriously as possible. Please read our Privacy Policy, which covers how we collect, use and protect this information.

In order to process your booking and provide services to you, we collect your personal data from you together with information about you that we learn when you use our website. Such data may include (as applicable) names, addresses, passport or other identification numbers, telephone numbers, e-mail addresses, other contact and payment information. In some cases, we may also collect information about your medical condition (applicable to customers with special medical requirements).

Please note that your data may be used for the following purposes: to provide services and products in response to your requests, to contact you in relation to your booking or purchased travel, statistical or marketing analysis, systems testing, customer surveys, customer relationship communications, to offer services that we think you may be interested in.

From time to time, we may contact you regarding our promotions in connection with travel or related products via email. However, you may opt out of receiving these types of communications by selecting the appropriate option when making a booking. You will also have the option to opt out of receiving newsletters in each email in which we send material.

We have appropriate policies and procedures regarding the storage and disclosure of customer personal information to ensure that such information is protected from unauthorized access by third parties.

We may disclose your information to government agencies to the extent that we comply with applicable laws.

We may also share some information with charter companies, port authorities and other relevant parties for the purposes of compiling official crew lists, transit logs and other formalities in connection with your travel arrangements.

You have the right to access any information we hold about you at any time and without charge.

As a data security measure, we may ask you to provide us with specific information to help us identify you and verify that you have the right to access your personal information.

This Privacy Policy applies solely to sites under our ownership and control. It does not cover links to other sites, nor does it cover any information collected by the owners or controllers of such third party sites or their use of cookies. You can read the privacy policies of such third parties separately.

You agree that the crew or representatives of Loveyachttours may take photographs and films of you during your trip and that these may be used in our group brochures and/or advertising or publicity materials without obtaining any further consent or payment in respect of such photographs and/or films. If you do not want your photos to be used in this way, please let us know at the time the photographer or other staff member takes your photos or movies.

We expect responsible behavior from each tour participant and compliance with the rules of the tour, excursions and activities as communicated to you by the guide/skipper or other member of our staff. You are responsible for any damage or loss caused by you or members of your group on the tour.

If you or anyone in your group exhibits behavior that is likely to endanger or inconvenience third parties or property, we may terminate the contract with such person without notice or any refund. We also have the right to exclude such person from the tour without any further obligation towards them.

We strive to provide you with the highest quality of service. Should any situation arise, please inform us, the charter company manager or your guide/skipper as soon as possible so that we can resolve the issue on the spot.

These Booking Conditions, and any matter relating to our relationship with you, shall be governed by and construed in accordance with the laws of the country in which the Loveyachttours event will take place or the International Maritime Law. Any dispute or claim arising out of or in connection with these Booking Conditions or the customer contract shall be resolved by negotiation. In the event of an inability to resolve a dispute in this way it may be referred to the courts.

We reserve the right to amend these Booking Conditions at any time without any notice – by publishing a new version on our website.

In addition to information directly from Loveyachttours, you can get all the information you need about Loveyachttours prices, schedules and event conditions through an agent. (hereafter Ambassador). We do our best to ensure that Ambassador has all up-to-date information on events, activities and prices. Any bookings are made exclusively through Loveyachttours. Before booking, you may be sent a personalized Ambassador promo code giving you a discount on any Loveyachttours event. An up-to-date list of Ambassadors can be obtained by sending a request to info@loveyacht.tours.

Ambassadors receive rewards and special terms and conditions on Loveyachttours products as per the agreement between the Ambassador and Loveyachttours. According to Loveyachttours policy, the price of the event (adventure) on the website cannot differ from the price at the Ambassador, except for the discount by promo code, which will be provided to you by the Ambassador at the time of booking.

As per Loveyachttours policy, all Ambassador promo codes give equal promotions and bonuses for the same event. However, there may be different amounts of promotions for different events.
